Capital Automotive Equipment LLC Warranty

Thank you for choosing Capital Automotive Equipment LLC (CAEL). We value your trust and want to ensure you are well-informed about our warranty policy. Please review the following details carefully:

1. Warranty Claims

To process a warranty claim, please send images showing the issue and the overall condition of the product to service@capitalautoequipment.com. Both photo and video documentation are required for all claims. Claims without this visual evidence cannot be processed.

All warranty claims must be approved by the manufacturer to be considered valid. Note that our warranty does not cover labour costs, and CAEL does not provide technicians for repairs or cover repair expenses.

2. Freight Damages and Missing Parts

If you encounter any freight damages or missing parts, please report them via email within 24 hours of delivery. Provide a written description, images of the damage, the original invoice, and the serial number plate. Minor aesthetic imperfections such as dents, scratches, surface discoloration, or mild surface rust, which may occur during transit, do not affect the equipment’s functionality and are not covered under warranty.

3. Freight Costs

The warranty does not cover freight costs, including air express shipping and standard ground shipping. Replacement components may need to be shipped by sea, which can take between 45 to 60 days.

4. Non-Transferability

The warranty is non-transferable and is valid only for the original purchaser.

5. Warranty Coverage

Structural Components: Covered for five years.

Principal Components: Includes cylinders, air or electric hydraulic power units, and pneumatic power units, covered for one year from the date of invoicing.

● Consumable Components: Includes cables, hoses, locks, pulleys, sheaves, bushings, pads, and slide blocks made from soft materials like rubber, nylon, and neoprene, covered for 120 days from the date of invoicing.

6. Coverage for Specific Products

1-Year Warranty on automotive equipment parts.
3-Month Warranty on skid steer attachments.
1-Year Warranty on parts for excavators, wheel loaders, skid steers,
tractors, and forklifts.
6-Month Warranty on pallet jack parts.

7. Exclusions

The following are not covered by the warranty:
a. Damage resulting from negligence.
b. Damage due to unauthorized modifications.
c. Damage caused by failure to follow the user manual.
d. Natural wear on parts designed to wear out (e.g., blades, teeth, cables, wheels,
shanks, cutting edges, PTO shafts, hoses).
e. Damage from use in unsuitable environments.
f. Excavator and skid steer tracks, and wheel loader tires.
g. Depreciation or damage from accidents.
h. Damage from natural disasters (e.g., fire, flood).
i. Repairs to units reported as stolen, damaged, or deemed a total loss.
j. Equipment not sold by Capital Automotive Equipment LLC.

8. Installation and Maintenance

The warranty is void if the product is not installed, used, and maintained according to the manufacturer’s installation, operation, and maintenance instructions.

TERMS AND CONDITIONS OF SALE

1. Pricing: Prices may change without prior notice and are not guaranteed unless an order is formally accepted by Capital Automotive LLC (“Seller”). Prices do not include any applicable sales, use, excise, or other taxes imposed by federal, state, or local authorities. These taxes and charges are the responsibility of the Buyer unless the Buyer provides a valid exemption certificate.

      2. Order Acceptance: Seller reserves the right to reject any order and is not obligated to fulfill any order until it has been formally accepted. These Terms and Conditions of Sale will govern the relationship between the parties and will take precedence over any conflicting terms proposed by the Buyer. Any modifications to these terms must be agreed upon in writing by Seller.

      3. Order Changes: Requests by the Buyer to modify an order may affect the delivery schedule and may lead to price adjustments. Such changes are only binding if agreed upon in writing by both parties. Seller reserves the right to update these Terms and Conditions without prior notice; however, the terms in effect at the time of order acceptance will apply.

      4. Shipments: Products are delivered from Seller’s facility. The risk of loss or damage transfers to the Buyer once the shipment is handed over to the carrier. Delivery dates are estimates and not guaranteed due to factors beyond Seller’s control, such as material shortages and manufacturing conditions. Seller is not responsible for any delays or damages arising from shipping issues.

      5. Claims: Claims for shipment errors must be made within 24 hours of receiving the products.

      6. Returns: Products cannot be returned or refunded once they leave our warehouse.

      7. Order Cancellations: Cancellations require Seller’s prior written consent and may incur cancellation charges. Orders for custom or non-stock items, items currently in production, or items ready for shipment cannot be canceled. Specialty products can only be canceled with written approval from Seller and may incur charges.

      8. Specifications and Materials: Specifications, weights, dimensions, and descriptions are approximate and subject to change without notice. Seller may substitute equivalent materials if shortages occur.

      9. Warranty: Please refer to the warranty policy provided separately.

      10. Liability Limitation: Seller is not liable for incidental, consequential, special, or indirect damages, including lost profits or business interruptions, related to this agreement or product use.

      11.Default: If Buyer fails to meet payment terms or if Seller finds Buyer’s financial condition inadequate, Seller may refuse to process orders, cancel existing orders, delay shipments, or require advance payment.

      12.Non-Assignment: Buyer may not assign orders or any rights or obligations without Seller’s prior written consent.

      13.Waivers and Modifications: No waiver or modification of these terms will be valid unless made in writing and signed by an authorized representative of Seller.

      14.Excusable Delay: Seller is not liable for delays due to events beyond its control, such as natural disasters, war, legal compliance, or labor disputes. Delivery dates will be extended by the duration of such delays.

      15.Information Disclosure: Any information or ideas provided by Buyer to Seller are not considered confidential unless specifically agreed upon in writing by Seller.
